The VALLEY Reporter Terms and Conditions
1. No part of any advertisement(s) designed by The Valley Reporter may be reproduced or transmitted in any form or by any means, electronic or mechanical including photocopying, recording or by any information storage and retrieval system without permission in writing from The Valley Reporter.
2. Trading terms are strictly 7 days from the date of invoice. No credit will be issued.
3. Accounts that are overdue will be first issued a ‘statement’. If no response is received or arrangements made a ‘final notice’ will be issued. If no further response is received or arrangements made to the ‘final notice’ then this will authorise the publisher to hand over the overdue account to a nominated Debt Recovery Department. The total amount will then incur ongoing collection and legal fees until payment has been made in full. Once an overdue account has been issued to the nominated Debt Recovery Department and the account still remains in arrears the accepted authorised Advertisement Booking Sheet will automatically become invalid.
4. The publisher accepts no responsibility for instructions given over the telephone. Written confirmation of instructions must be accepted and be received before the publications outlined deadlines.
5. All artwork and related work to be published in The Valley Reporter will be designed/created by The Valley Reporter. All other artwork/materials etc. designed and created for purposes other than publication in The Valley Reporter is done by the business F.N. Grafix.
6. If the publisher is found to be at fault for errors in any advertisement, the advertisement in question will be corrected and a reprint of that advertisement will automatically take place in the next available publication.
7. Contract rates advertised are subject to change without further notice.
8. Copyright in all artwork or advertisements created by The Valley Reporter for you will belong to ©Kiwi Enterprises (WA) Pty Ltd as Trustee for the Newland Family Trust trading as The Valley Reporter. Initial artwork charges relating to the design of your advertisement have been incorporated in the advertised contract rates. Further alterations of advertisements will be charged out accordingly.
9. ©Kiwi Enterprises (WA) Pty Ltd as Trustee for the Newland Family Trust trading as The Valley Reporter is the owner of copyright in all advertisements and photographs to be designed and taken respectively by The Valley Reporter.
10. Requested retrieval or collection of artwork may incur extra charges.
11. The Valley Reporter will take all due care to ensure advertisements appear as booked, however The Valley Reporter will not be liable for any loss and/or damage (including consequential loss or damage) which may be suffered or incurred or which may arise directly or indirectly from the failure of any advertisement to appear as booked.
12. Publications and placement of advertisements within The Valley Reporter will be at the discretion of the publisher unless you are booking an exclusive position, which incorporates extra charges.
13. As a free service, every advertiser that places an advertisement with The Valley Reporter will be listed within a section of The Valley Reporter called “Quick Find”. The idea of it is for it to be used as a fast reference to businesses. Each business will have a maximum of three (3) lines which will include a company name, address and contact details and these will be categorised and listed alphabetically.
14. By lodging an advertisement, artwork and/or text and/or images with the publisher:
(a) you license the publisher to reproduce any copyright provided to the publisher for the purpose of placing the advertisement in The Valley Reporter;
(b) warrant that you are the owner of the intellectual property in the advertisement and/or artwork and/or text and/or images that you have provided to The Valley Reporter and that the publication of your advertisement will not give rise to any rights against or liabilities to the publisher, its servants or agents and in particular that nothing therein is capable of being misleading or deceptive or otherwise in breach of the Trade Practices Act 1974;
(c) indemnify the publisher, its servants and agents against all liability, claims or proceedings whatsoever arising from the defamation, slander, infringement of intellectual property rights (whether registered or not), or violation of rights of privacy and all expenses, losses, damages and costs that the publisher may sustain or incur as a result, whether directly or indirectly, of any claim by any person arising out of its publication of the advertisement placed by you.
15. All Advertisement Booking Sheets signed as acceptance authorised and received by The Valley Reporter are binding contracts.
16. Cancellation Policy: Any advertisement cancelled:
(a) at least 7 days before the publications outlined deadlines will be liable to pay a $50.00 administration cancellation fee;
(b) within 5 days of the publications outlined deadlines will be liable to pay 50% of the contract rate for each advertisement placed; or
(c) within 2 days of the publications outlined deadlines will be liable to pay for 75% of the contract rate for each advertisement placed.
17. Due to popular demand there is now a limited time frame set in place for exclusive positioned advertising which will be based on a ‘first come first served“ basis. Front cover advertising can only be booked for a period of three (3) or six (6) months at any given time (Front Cover Periods). This allows the front cover to have a regular rotating exclusive position available for any advertiser who wishes to commit to the Front Cover Periods. All exclusive front cover advertisements can only be booked for the Front Cover Periods and, any further periods will be at The VALLEY Reporter’s discretion.
The VALLEY Reporter Disclaimer
“Subject to any rights and remedies available under the law of any State or Territory of Australia or the provisions of the Trade Practices Act 1974 which cannot be excluded, restricted or modified, the publisher:
(a) does not provide any representation or warranty as to the accuracy or completeness of any information contained in any printed material published;
(b) excludes all liability for any misrepresentation which may arise out of the publication of any printed material;
(c) shall have the right to refuse or cancel any printed material.”
